On International Women’s Day 2025, GIDII Advocacy convened a critical industry roundtable to address the pressing issues surrounding Independent Medical Examinations (IMEs) and medical misogyny. This landmark event brought together a diverse group of stakeholders, including lived experience survivors of the system, psychologists, healthcare professionals, insurers, and the regulator, to discuss the urgent need for reform in the independent examination process.
A key focus of the roundtable was a presentation, which highlighted the inconsistencies between the two existing codes governing Independent Examiners—one for the Court and another for the Personal Injury Commission. This discussion underscored the necessity of establishing a single, unified code to enhance transparency, fairness, and accountability in the assessment process.
GIDII Advocacy is committed to advancing this crucial discussion and will continue to advocate for a unified code for Independent Examiners. As part of this effort, a proposed solution was introduced to address the discrepancies between the two existing expert witness codes. While not legal advice, the following phrase was suggested for legal review:
“I acknowledge having read the Expert Witness Code of Conduct, Schedule 7 of the Uniform Civil Procedure Rules, and also the Procedural Direction PIC4. I agree to be bound by both of these wholly and concurrently.”
GIDII Advocacy remains dedicated to driving systemic change and ensuring that all individuals navigating the IME process are treated with dignity, fairness, and respect. We look forward to continued collaboration with stakeholders to reform this critical aspect of the personal injury system.
